The extent of incidents of clinical negligence
Department of Health statistics suggest around 500,000 patients are accidently harmed annually of these only 30,000 complain. Even fewer people, around 6,000, seek compensation through litigation.
In addition the NHS Litigation Authority estimates £10 billion in liabilities from reports of accidents where there would be right to compensation, and only £870 million including costs paid out last year
Recent thoughts on clinical negligence
The journal of quality and safety in healthcare published a study that suggested that 1 in 10 NHS patients suffers harm in hospital. Up to a half on these incidents may be avoidable, and a significant proportion of these incidents have led to the patient's death. The types of problems that are experienced are discussed elsewhere on this website, but it would appear that the extent of the problem has been underestimated.
Public perception of making claims
A survey run by the leadership factor suggested that the majority of respondents believe that the UK is becoming increasingly more like the USA with its 'claim culture', and financially motivated claimants. However, on a subjective level approximately the same number of people would consider taking legal action if their own health was affected by a mistake made by the NHS.
