Private dental work

In 2006 the General Dental Council lauched an independent complaints service for treatment paid for pirvately. The procedure is outlined on the website but basically, it is independent from the NHS and the government, and can be used for mistakes of diganosis, consent, and receiving the wrong or unsatisfactory treatment, aswell as complaints about service received generally.

As with most complaints procedures there are advantages and disadvantages in pursuing this option rather than simply suing the dentist in law. For example in most cases matters can be put right over the telephone, the service is free and generally fast. Occasionally you may have to discuss issues with your dentist at a meeting convened by the complaints service, but this should be non adversarial, unlike in a court. Solicitors are not involved at all.

However, you need to have already made some attempt to sort out the complaint with the dental practice, using their complaints procedure. It may also be difficult to assess the complaint yourself without a second opinion or an understanding of the dental records. Finally the maximum award that the panel can make is twice the cost of the treatment with no award for costs or general damages i.e. pain and suffering
