NHS Redress Act 2006
The Act is designed to make the compensation system easier and quicker for smaller negligence claims, as it was thought that these would increase, as patients became more aware of their rights. The threshold was proposed to be a claim of value up to £20,000. In these cases the redress scheme could be applied without recourse to legal action. It should provide compensation of an approximately equal level. The Act does not cover private healthcare, or care from GPs or dentists. The body responsible for handling the claims is the NHS litigation authority. They have been charged with deciding liability and compensation as well as investigating the claims, leading to worries about lack of independence. There is no appeal from the scheme, but litigation may be commenced after recourse to the scheme.
